These terms govern your use of pearos.xyz, operated by Pear Software and Services S.R.L. (CUI 50888207, Nr. Reg. Com. J2024041454000), an independently run open-source project, registered office at 133 Dacia Blvd, Floor D, Sector 2, Bucharest 020056, Romania, reachable at alex@pear-software.com. By using this site, you agree to them.
1. About pearOS
pearOS is a free, open-source Linux distribution. Its source code is licensed under the GNU General Public License v3.0 (GPL-3.0). This website's own content, design, and branding ("pearOS", the logo, and related marks) are not covered by that license and remain the property of Pear Software and Services unless stated otherwise.
2. Downloads and speed tiers
ISO downloads are always free to obtain. By default, downloads are rate-limited to approximately 2 MB/s. If you choose to support the project financially through the on-site prompt, you receive a temporary, individually signed download link that removes this limit for 4 hours. This is a thank-you perk for voluntary support, not a purchase of the software itself — pearOS remains free and open source regardless of whether you ever support it financially.
3. Donations and payments
Donation amounts are entirely voluntary ("pay what you want"). Payments are processed by Stripe, PayPal, Ko-fi, or Patreon under their own terms; we never receive or store your full card details.
Where a donation is made specifically to unlock full-speed downloads, by completing that payment you expressly request immediate performance of this digital service and acknowledge that, once the unlocked link is issued, you lose the statutory 14-day withdrawal right under Article 16(m) of Directive 2011/83/EU as transposed into Romanian law by OUG 34/2014. General, undirected donations (e.g. via PayPal, Ko-fi, or Patreon with no service attached) are not exchanges for goods or services and the withdrawal right does not apply to them in the first place.
Mistaken or duplicate payments can be reported to alex@pear-software.com and will be reviewed case by case.
4. Acceptable use
- Do not attempt to circumvent, abuse, or overload the download or payment infrastructure.
- Do not resell or redistribute unlocked download links.
- Do not use this site to distribute malware or engage in unlawful activity.
5. Third-party services
This site links to and embeds third-party services (Stripe, PayPal, Ko-fi, Patreon, GitHub, Cloudflare, Google, Microsoft) that operate under their own terms and privacy policies, which we do not control.
6. Disclaimer of warranties
This site and the pearOS software are provided "as is", without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or uninterrupted availability. As stated in the GPL-3.0 license, the software carries no warranty to the extent permitted by applicable law.
7. Limitation of liability
To the maximum extent permitted by law, Pear Software and Services will not be liable for any indirect, incidental, or consequential damages arising from your use of this site or the software it distributes.
8. Governing law and dispute resolution
These terms are governed by Romanian law. If you are a consumer and have a complaint that we haven't resolved directly, you may refer it to the National Authority for Consumer Protection (ANPC) through its Alternative Dispute Resolution platform at reclamatiisal.anpc.ro (SAL).
Note: the European Commission's Online Dispute Resolution (ODR) platform was permanently discontinued on 20 July 2025 and is no longer available. The list of national alternative dispute resolution bodies across the EU is maintained at consumer-redress.ec.europa.eu.
9. Changes to these terms
We may revise these terms from time to time. Continued use of the site after a change constitutes acceptance of the revised terms.
