Refund Policy
Last updated: November 2, 2026
This policy explains when payments made on pearos.xyz are refunded: donations, and purchases of paid pearOS builds (currently the UltraC0re BSD Developer Preview). The site is operated by Pear Software and Services S.R.L. (CUI 50888207, Nr. Reg. Com. J2024041454000), registered office at 133 Dacia Blvd, Floor D, Sector 2, Bucharest 020056, Romania, reachable at [email protected]. It applies together with our Terms of Use and Privacy Policy.
1. What this covers
Donations are voluntary, pay-what-you-want amounts, including those given to unlock full-speed downloads of the free builds. Paid builds are builds sold for a price; today that is pearOS UltraC0re (BSD), a Developer Preview. Card payments are processed by Stripe. Donations made through PayPal, Ko-fi or Patreon are also subject to those services' own refund rules.
2. Donations
Donations are gifts and are generally not refundable. We will refund a donation when:
- it was a mistake or a duplicate (for example you were charged twice, or entered the wrong amount);
- the charge was not authorised by you (please tell us as soon as you notice); or
- you paid to unlock a faster download and, because of a technical problem on our side that we cannot fix, you could not get the file.
Please contact us as soon as you notice, ideally within 30 days; we may still consider later requests. For donations made through PayPal, Ko-fi or Patreon, please also contact that service.
3. Paid builds (UltraC0re BSD)
A paid build is digital software that is delivered immediately: your download link is issued as soon as the payment is confirmed. For that reason payments for paid builds are final and non-refundable once the link has been issued, including where you simply change your mind.
Before paying you are shown our terms and asked to confirm that you understand that this is software that is not refundable, that it is experimental, and what its current limitations are. The following are therefore not grounds for a refund: the build being a Developer Preview or work in progress; the limitations described on the BSD page and at checkout (for example no installer, no web browser, CPU-only rendering and limited Wi-Fi, Bluetooth and GPU support); or the build not working on your particular hardware or virtual machine.
We will fix or refund in full where: you were charged twice or by mistake; the charge was not authorised by you; or you paid and we did not deliver a working download (the link or the file does not work and we cannot resolve it). In delivery problems we first try to fix the delivery, and refund if we cannot.
4. Consumers in the EU and Romania
EU consumers normally have a 14-day right of withdrawal for distance contracts (Directive 2011/83/EU; in Romania, OUG no. 34/2014). That right does not apply to digital content that is not supplied on a tangible medium once performance has begun with your prior express consent and your acknowledgement that you lose the right of withdrawal (Article 16(m) of the Directive; Article 16(m) of OUG 34/2014). For paid builds we ask for that consent and acknowledgement before payment and keep a record of it (the version of the terms and of the confirmation page you accepted, the time, and your IP address, together with the time, country and IP address of the moment your download link is issued; see our Privacy Policy). Because the link is issued immediately after payment, the right of withdrawal ends at that moment.
Your statutory rights if digital content does not conform to the contract (Directive (EU) 2019/770; in Romania, OUG no. 140/2021) are not affected by this policy and cannot be excluded. Whether a build conforms is judged against how it is described, including the Developer Preview and experimental warnings above.
5. Customers in the United States
US law does not give a general right to cancel or to a refund for digital software once it has been delivered, so this policy applies as written. It does not limit any right you have under federal law or under the consumer protection laws of your state that cannot be waived by contract. If you believe a charge is wrong, please contact us before disputing it with your bank.
6. How to ask for a refund
Email [email protected] with the email address used for the payment, the date and amount, and the reason. We aim to answer within 5 working days. Approved refunds are returned in full, in the currency you paid, to the original payment method through Stripe; depending on your bank they usually appear within 5 to 10 working days.
7. Disputes and chargebacks
If you dispute a charge with your bank or card issuer without contacting us, we will give Stripe and the bank the records we hold to show what happened: your payment, the terms and confirmation you accepted, and delivery of the download (including timestamps, country and IP address). Contacting us first is almost always faster.
8. Complaints
If you are a consumer and we have not resolved your complaint, you may refer it to the Romanian National Authority for Consumer Protection (ANPC) through its alternative dispute resolution platform at reclamatiisal.anpc.ro (SAL), or to your own country's consumer authority.
9. Changes to this policy
We may update this policy; the date at the top shows the latest revision. A change applies to payments made after that date.
